Procedure:
The St. Peters Church Farm will be offered as one tract in a virtual online-only timed auction. Bidding will open at 9:00 a.m. CST and close at 12:00 p.m. CST on Thursday, September 4, 2025. Bidding and registration will be available at: https://bid.hiattland.com/ui/auctions/144264/20223523.
All bidding will be on a total dollars basis, based on taxable acres (no new survey). There will be no in-person bidding and no scheduled inspections, as this is tillable farmland only.
Registration:
All prospective bidders must register online prior to bidding. Hiatt Enterprises may request a letter of recommendation from a prospective bidder’s financial institution confirming funds are available for the 10% earnest money deposit and the financial capacity to close.
Acceptance of Bid Prices:
The successful high bidder will enter into a Contract to Purchase immediately following the close of bidding, subject to seller approval. Upon the close of the auction, the winning bidder must sign the purchase contract electronically (DocuSign) or return a signed copy by email to Rick@HiattLand.com by the deadline specified.
Down Payment:
A 10% non-refundable earnest money deposit of the total purchase price will be due within 24 hours of signing the purchase contract. Payment shall be made by wire transfer, personal check, business check, or cashier’s check to the designated escrow agent. The balance of the purchase price is due in cash at closing. The sale is not contingent on financing.
Closing:
Closing shall take place on or before 60 days after the auction date. Seller will convey merchantable title by warranty deed and provide an owner’s title insurance policy at seller’s expense.
Possession:
Possession will be granted immediately following the harvest of the 2025 crop.
Taxes & Prorations:
2025 real estate taxes due and payable in 2026 will be prorated to the date of closing. The 2025 cash rent, if any, will also be prorated accordingly.
Mineral Rights:
The sale shall include any and all mineral rights currently owned by the seller, if any.
Acreages & Survey:
Sale is based on taxable acres using the existing legal description. No new survey will be provided.
Easements:
The sale is subject to any and all recorded easements and rights-of-way.
Agency:
Hiatt Enterprises and its representatives are exclusive agents of the Seller.
